Traps when hiring new staff

Hiring staff is by no means an easy task. As employers, you’re trying to find someone who not only has the right qualifications and experience but will also fit into the company’s culture. When on the hunt for the ideal employee, there are certain traps you should watch out for. Under Australian employment law, employers have various obligations, not only to employees but also potential employees. It will cost time and money to wrangle your way out of the trap once you’ve fallen in.

Deceptive and misleading conduct

Lastly, it is important that employers stay away from making promises or representations during the recruitment process that cannot be kept.

For example, statements such as “We are booming”, “You will have a job for life”, “You’ll make $300,000 a year within 12 months.”

If the candidate gives up another opportunity to take up that offer but you do not then offer the candidate a position or they do not make $300,000 a year, the candidate may make a claim of deceptive and misleading conduct under Australian Consumer Law.

– What is your background? Which country are your parents from?

– How many children do you have?

– Are you married?

Tips for employers

Carefully consider the language and content of job advertisements. After you have drafted the selection criteria, check they relate to the inherent requirements of the position.

Critically analyse the position’s tasks. For instance, weights lifted, frequency of standing and sitting etc.

Plan and review as many interview questions as possible, before going into the interview. Ensure the questions are relevant to the selection criteria.

If using a selection panel to interview staff, ensure that members have wide-ranging attributes.

Be mindful of having an unintentional or unconscious bias. Avoid making promises during the interview.
